Terms of Service
Last updated October 31, 2026 Draft for lawyer review
The Bud app for iPhone and the website at getbud.app (together, the “Service”) are made by Kin Money, LLC, doing business as Bud (“Bud,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Service. By downloading or using the app, joining our waitlist, or using the website, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. What Bud is, and what it isn’t
1.1 A private journal. Bud is a journal for iPhone for the people you hook up with and date, the times you play, and the tests you take. What you log is stored on your iPhone and, if you turn on sync, in your own iCloud. We don’t have a copy.
1.2 Not medical advice. Bud’s reminders, stats, guides and suggestions are general information and tools for keeping your own records. They are not medical advice, a diagnosis, or a substitute for a doctor or clinic. Our Health disclaimer explains more. In an emergency, call 911.
1.3 Not a social or dating service. Bud doesn’t connect you with anyone, and nothing you log is shared with other people through Bud.
2. Who can use Bud
You must be at least 18 years old, and the age of majority where you live, to use the Service. Bud has no accounts: you’re responsible for who can use your iPhone and your journal, so keep a passcode on your phone and Bud’s Face ID lock on.
3. Your journal and other people
3.1 Your journal is yours. You own what you add to Bud (“Your Content”). Because it stays on your devices and in your iCloud, we don’t receive it and don’t need a license to it.
3.2 Other people’s information. Your journal is about other people too. You’re responsible for what you log about them. Only add information and photos you have the right to keep, and keep what you log private.
3.3 Acceptable use. You agree not to use Bud to:
- stalk, harass, threaten, blackmail, out or intimidate anyone;
- store or share intimate images of anyone without their consent;
- store images of anyone under 18 in a sexual context, which is illegal;
- publish or share someone’s private information, sexual history or health status without their permission; or
- break any law.
3.4 Contacts. If you choose to have Bud add a keyword and link to a contact card, that change is made in your Contacts app and syncs wherever your contacts do, outside Bud’s encryption. Think before you add details that someone with your contacts could see.
3.5 Back up your journal. We can’t see, restore or recover your journal. If you lose your iPhone or delete the app without iCloud sync on or a recent export, your journal may be gone for good. Turning on sync or exporting backups is up to you.
4. Free trial and purchases
4.1 Free trial. New users get 14 days with everything unlocked. You won’t be charged at the end of the trial unless you pick a plan. If you don’t, everything you logged stays readable and exportable.
4.2 Plans. Bud offers a yearly subscription and a one-time lifetime purchase. The prices are shown in the app and on the App Store before you buy, in your local currency.
4.3 Apple handles payment. All purchases are made through Apple’s App Store, under Apple’s terms. The yearly subscription renews automatically each year at the then-current price unless you cancel at least 24 hours before it renews. You can cancel any time in iPhone Settings, under your name, then Subscriptions. Cancelling stops the next renewal; it doesn’t refund the current year. Refunds are decided by Apple at reportaproblem.apple.com. “Lifetime” means for as long as we offer the app.
4.4 Price changes. If we change the price of the yearly subscription, Apple will tell you before it applies, and you can cancel before it does.
5. The website and our emails
If you join the waitlist, we’ll email you about Bud’s launch and send our newsletter. One list covers both. You can unsubscribe at any time with the link in any email. Our guides are general information, not medical advice. Some guides may include affiliate links; our Affiliate disclosure explains how they work.
6. Privacy
Our Privacy Policy, Consumer Health Data Privacy Notice and Cookie notice explain what little information we receive and how we handle it. They are part of these Terms.
7. Your license to use Bud
7.1 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes, and to use the app on Apple devices you own or control as allowed by the App Store’s Usage Rules.
7.2 Restrictions. You may not: (i) sell, rent, lease, sublicense, distribute or commercially exploit the Service; (ii) modify, decompile, disassemble or reverse-engineer it, except where the law allows despite this restriction; (iii) copy or republish the Service or its content except as these Terms allow; (iv) use bots or scrapers to access the website; or (v) try to get around any security or access control.
7.3 Ownership. The Service, including its design, text, graphics and code, belongs to us or our licensors. These Terms don’t give you any ownership rights, except the license in Section 7.1. All rights not expressly granted are reserved.
7.4 Feedback. If you send us feedback or ideas, we may use them for any purpose without paying you or giving you credit.
8. Changes to the Service
We may change, add or remove features, or stop offering the Service, at any time. Because your journal is on your devices, you can keep exporting it from the app you have. If we stop offering the app, we’ll try to give reasonable notice first.
9. Third-party services
The Service works with third-party services such as Apple (the App Store, iCloud and Contacts) and the dating apps whose screenshots you may add. We don’t control them, aren’t responsible for them, and aren’t affiliated with or endorsed by them. Their own terms and privacy policies apply. Their names are trademarks of their owners.
10. Apple’s App Store terms
These terms apply because you get Bud from Apple’s App Store:
- These Terms are between you and Bud, not Apple. Apple is not responsible for the app or its content.
- Your license to use the app is limited to Apple-branded products you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app. Bud is responsible for that.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation, and any other claims, losses or costs from a failure to meet a warranty are Bud’s responsibility, subject to these Terms.
- Bud, not Apple, is responsible for addressing any claims about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims.
- If a third party claims the app or your use of it infringes their intellectual property rights, Bud, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must follow any applicable third-party terms when using the app, such as your wireless data service terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
11. Ending these Terms
You can stop using the Service at any time by deleting the app and unsubscribing from our emails. We may end your license if you break these Terms. Sections 3, 7.3, 7.4 and 12 to 15 continue to apply after these Terms end.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, BUD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT REMINDERS WILL ALWAYS ARRIVE ON TIME, THAT STATS OR ON-DEVICE AI WILL BE ACCURATE, OR THAT YOUR JOURNAL WILL NEVER BE LOST. DON’T RELY ON BUD AS YOUR ONLY RECORD OF HEALTH INFORMATION OR AS A SUBSTITUTE FOR MEDICAL CARE.
13. Limitation of liability and indemnity
13.1 Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS: (A) BUD WILL NOT BE LIABLE FOR ANY LOST DATA, LOST PROFITS, OR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $50 USD AND THE AMOUNT YOU PAID FOR BUD IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME STATES DON’T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
13.2 Indemnity. You agree to defend and indemnify Bud against claims and reasonable costs, including attorneys’ fees, arising from your breach of these Terms or your misuse of the Service, including claims by people you logged.
14. Disputes
14.1 Talk to us first. Before starting a legal claim, the party raising a dispute must send written notice to the other describing it. Our notice address is help@getbud.app or 2261 Market Street STE 72267, San Francisco, CA 94114. Both of us will try in good faith to resolve it. If it isn’t resolved within 60 days of the notice, either of us may go to court as described in Section 14.2.
14.2 Governing law and courts. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and Bud agree to the exclusive jurisdiction of the state and federal courts in San Francisco County, California, except that either of us may bring an individual claim in small claims court, and either of us may seek an injunction in any court to protect intellectual property. Nothing in these Terms takes away a consumer protection that the law of the state where you live gives you and that can’t be waived.
15. General
15.1 Changes to these Terms. We may update these Terms. If we make material changes, we’ll update the date at the top and tell you in the app or by email before they take effect. If you keep using the Service after that, you accept the new Terms.
15.2 Entire agreement. These Terms, together with the policies they link to, are the whole agreement between you and Bud about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn’t a waiver. You may not assign these Terms; we may assign them as part of a merger, acquisition or sale of assets.
15.3 Electronic communications. You agree that we can communicate with you electronically, and that these communications meet any legal requirement to be in writing.
15.4 Accessibility. We aim for the website to meet WCAG 2.1 Level AA and for the app to work well with VoiceOver and Dynamic Type. If something is hard to use, tell us at help@getbud.app.
15.5 Copyright and trademarks. Copyright © 2026 Kin Money, LLC. Bud, the Bud wordmark and getbud.app are trademarks of Kin Money, LLC.
15.6 California consumer notice. Under California Civil Code Section 1789.3, California users are entitled to this notice: the Service is provided by Kin Money, LLC, 2261 Market Street STE 72267, San Francisco, CA 94114. To file a complaint or get more information, write to that address or email help@getbud.app. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N.
